本私隱政策概述我們如何收集、使用、管理和保護我們可能向閣下收集或所收集到有關閣下的個人資料（「個人資料」），並適用於其個人資料可能由海獅機械設備有限公司、其附屬公司、聯營公司及關聯公司（統稱「海獅」、「HAISHI」、「本公司」、「我們」或「我們的」）作為控制者或處理者經手的所有個人。根據香港特別行政區《個人資料（私隱）條例》－ 第486章（「條例」），就其責任及政策提供資料。

收集客戶個人資料之運作聲明

本公司將就 (i)到訪本公司的網站及使用應用程式；(ii) 產品貿易活動，包括買賣、租賃、交付和領取產品(iii)查詢及追蹤貿易詳情 (iv)用作我們的推廣活動；及 (v)其他有關的產品或服務，客戶可能被要求提供的個人資料，但不限於以下，如沒有便不能讓我們營運業務的資料：

1.個人和公司的聯繫資料〈包括姓名、公司名稱、實際地址、電郵地址、聯絡電話及傳真號碼等〉；
2.使用本公司服務的地址、通訊地址及/或寄發賬單的地址；
3.付款資料〈包括付款卡詳情或用作網上付款之賬戶資料及其賬單地址或相關賬戶資料如賬戶號碼等〉；
4.貿易信息〈包括 (a)托運方及收方的的姓名、實際地址、電郵地址及聯絡號碼，(b)作為交付證明的簽署，(c) 使用本公司月結賬戶服務的賬戶號碼，及 (d)提供給我們以幫助我們進入需提供服務之地點的信息〉及就某托運物品內容有關而提供之資料，但只限於該信息能識別閣下個人身份與托運物品內容相關的信息；
5.用以核對身份的資料，包括身份證明文件類別及號碼；
6.回應有關本公司服務滿意度調查的內容；
7.當閣下填寫在「取得報價」、「聯絡我們」或「訂閱我們」表格時，我們將收集閣下的個人資料。
8.閣下移動設備之定位資訊（只適用於閣下使用某些應用程式之指定服務）；
9.操作機械設備或使用服務之人士的錄像；或
10.使用本公司產品或服務而提供之其他個人資料。

10.為提供產品及服務，於其他目的及而從其他來源（包括第三者）所收集的資料而與閣下的資料匹配（定義見《個人資料（私隱）條例》）；
11.若根據條例規定下取得閣下的同意，本公司及關聯公司、代理、承辦商及第三方供應商的任何產品及/或服務之推廣或宣傳；
12.本公司及關聯公司、代理、承辦商及第三方供應商的業務策劃及向閣下所提供之產品及/或服務進行改善，13.而該等策劃及改善可以不同方法進行，包括但不限於研究、分析及/或調查；
就本公司向閣下提供的產品或服務作分析、核實、執行合同的權利及/或查核閣下的信用、付款及/或狀況；
14.使本公司能作出閣下在本公司的賬戶之日常運作及/或收取閣下賬戶未付的款項，包括聘用追收債務代理人；
15.維護和開發本公司的業務系統和基礎設施，包括測試及更新該等系統；
16.通知閣下有關本公司已提供及其他產品和服務的最新資訊；
17.防止、偵查或調查犯罪活動；
18.法例要求或准許之披露的事項；及/或
19.閣下與本公司任何其他共同同意的其他用途。

同意

當閣下按照我們收集資料時所說明之目的而向我們提交資料，即表示閣下已經閱讀和理解本私隱政策，並同意我們收集閣下的個人資料及將其用於與本政策中所述的所有目的以及相關的用途。然而，我們不會使用閣下的個人資料作直銷，包括閣下的姓名和聯絡方法，除非我們已經收到閣下要求「取得報價」、「聯絡我們」或「訂閱我們」的申請。

使用資料作市場推廣

當閣下申請我們的「取得報價」、「聯絡我們」及「訂閱我們」的申請，我們會使用閣下的個人資料作市場推廣；我們將會使用閣下的姓氏、名字及電郵地址推廣以下的服務及產品：

1.海獅機械設備之產品和服務；
2.海獅機械設備之商業貨品；
3.海獅機械設備及其子公司、附屬公司及/或聯屬公司提供的消息、獎賞、推廣和活動。

個人資料的保存

個人資料會保存至達到與收集上述資料目的，或直接有關之目的為止；除非上述個人資料可根據任何適用法例或合約規定須予以保存。

個人資料的披露

本公司所持有的全部個人資料將予以保密，然而本公司可在有需要披露此等資料以達到收集此等資料之目的，或直接與其有關之目的時，向下述人士披露資料：

1.任何附屬公司、控股公司、關聯公司，或由本公司所持有或與本公司同屬一家控制公司的公司或聯營公司；
2.任何代表本公司或與本公司聯營的個人或公司，以達到提供此等資料之目的，或直接與其有關之目.
3.本公司的經銷商、代理、承辦商、供應商；本公司的專業顧問，包括會計師、審計師及律師；
4.由法律規定或授權的政府和監管機構、執法機構和其他組織；
5.有關本公司全部或部分運營業務的任何潛在或實際參與者、承讓人或受讓方；

個人資料也可根據任何法定或合約責任或法院規定向任何人披露，但他們須證明其取用資料的權利/權能。此外，個人資料可能在條例第VIII部分所列明的情況下被披露，其中有關個人資料獲豁免而不受保障資料原則第3條所管限的。

將個人資料轉移至香港以外地方

本公司在有需要時會將若干個人資料轉移至香港特別行政區以外的地方以達到收集此等資料之目的，或直接與其有關之目的。該轉移會遵守條例現行之規定。

個人資料的保安

凡未經管理層正式授權的人士，不得取用記錄及數據。有關權利只在「必須知道」的情況下授予，並根據個別人士在公司的職責及受訓情況而定。

鏈接第三者網站

本公司網站或包含可通往由第三者營運的其他地址及頁面的鏈接。本公司無法控制該等被鏈接網站的內容或該等網站營運商處理閣下個人資料的方式。閣下應審閱該第三者網站上的私隱政策，以暸解該等第三者可能使用閣下個人資料的方式。

直接促銷

若閣下同意，本公司可使用閣下的個人資料（包括姓名、聯絡資料及有關閣下已選購或申請的產品和服務資料），以電郵地址、通訊地址、手機號碼、電話號碼、服務號碼和服務賬戶號碼等透過不同聯絡方式，向閣下傳遞不同的推廣資料，包括本公司的產品和服務、電腦周邊產品、配件和流動應用程式、個人助理服務和資訊服務的最新情報、禮品、折扣、優惠及資訊。本公司亦可能向客戶提供各種產品或服務的最新情報。為釋除疑問，該同意可以在任何時候根據此私隱政策聲明撤回而不受服務合約時限所規管。若該同意未經撤回，在合約結束後仍然有效。倘若閣下希望停止或（若閣下已取消接收）重新接收本公司的資訊，閣下可隨時通知資訊科技部您的聯絡方法。所有此等要求，應明確列出有關要求的個人資料詳情。

查閱及改正個人資料

若閣下希望查閱或更正我們持有的閣下的任何個人資料，或要求我們刪除任何不再因爲我們提供的服務而需要保存的資料，你可以以電郵方式（marketing@hsm-is.com）或寄信給海獅機械設備有限公司，地址為香港新界荃灣海盛路3號TML廣場28樓B2-3室與我們聯絡。

我們可因應閣下的要求所查閱的資料收取行政費。閣下可以拒絕與我們分享你的個人資料及╱或撤回你作出的任何同意，在這種情況下，我們可能無法向你提供我們的某些服務。

GENERAL

This Privacy Policy Statement provides information on the obligations and policies of Hai Shi Machinery & Equipment Co., Ltd, its subsidiaries, affiliates, and associated companies (collectively, the “HaiShi”, “HSM” “Company”, “we”, “us” or “our”) under the Hong Kong SAR Personal Data (Privacy) Ordinance – Cap.486 (the “Ordinance”).
This Privacy Policy Statement specifically describes the Company’s obligations in respect of the data privacy laws of the Hong Kong SAR. Our privacy practices may vary among the countries in which we operate to reflect local practices and legal requirements.
In this Privacy Policy Statement, the meaning of the term “personal data” is as defined in the Ordinance.
Please read the following carefully to understand our policy and practices regarding how your personal data will be treated. By submitting your personal information for the purposes for which it is collected, you indicate that you have read and understood this privacy policy and you are consenting to our collection and use of your personal information in association with all purposes described in this policy.

STATEMENT OF PRACTICES OF PERSONAL DATA COLLECTED FROM CUSTOMERS

For the purpose of carrying on the Company’s businesses, including (i) uses of the Company’s website and applications; (ii) product trading activities, including sell, rent, delivery and pick-up of products; (iii) enquiries on product and tracking; (iv) promotion events hold by us; and (v) other related products and services, customer may be requested to provide personal data such as, but not limited to, the following, without which it may not be possible to carry out our businesses:
1. Individual and business contact information (such as name, company name, physical address, email address and telephone or fax number);
2. Service installation address, correspondence address, and/or billing address;
3. Payment information (including payment card details or online payment services number and invoicing address) and financial information (such as bank account numbers);
4. Trading information (such as (i) product-related contact details like the shipper’s and consignee’s name, physical address, email address and telephone number, (ii) signature for proof of delivery, (iii) the Company’s account number, and (iv) information given to us that helps us access locations to which we provide service) and information provided to us regarding the content of certain shipments, but only to the extent an identifiable person can be linked to such content;
5. Information for the verification of identity, including identification type and identification number;
6. Information provided in response to surveys;
7. When you fill in “Submit”, “Contact Us” or “Subscription” form or enquiry;
8. The geographic location of your mobile device if you use certain features of our mobile applications;
9. Video capture of equipment when using the product or application; or
10. Other personal information that may be provided to us to obtain the Company’s product or service.
In addition, when you visit our websites, use our mobile applications, or interact with our tools, widgets or plug-ins, the Company’s web servers may also collect data relating to your online session by automated means, the use of which is to provide aggregated, anonymous, statistical information so that the Company may better meet the demands and expectations of visitors to its sites, and take necessary actions in respect of any illegal or unlawful contents on any website visited through the Company’s web servers. The types of data may include, but are not limited to: the browser characteristics; operating system; IP address and/or domain name; language preferences; device characteristics; URLs; information on actions taken; and dates and times of activity.
A “cookie” is a text file that the Company’s websites send to your machine to uniquely identify your browser or to store information or settings in the browser. This information may include, but is not limited to, relevant login and authentication details as well as information relating to your activities and preferences across the Company’s websites. You can disable cookies on your web browser, however ,if you do so, you may not be able to access all parts of our websites.
Telephone calls and/or messages made to and from the Company’s service hotlines and/or inquiry telephone numbers will be recorded for the purposes of quality control, appraisal, as well as staff management and development. At all times, care is taken to protect such recordings from inadvertent and/or unauthorized access. Any personal data supplied by you will be retained by the Company and will be accessible by our employees and third parties (as applicable) for the purposes set out in this Privacy Policy Statement or as otherwise indicated by prior notice to you.

USE OF PERSONAL DATA

Your personal data may be used for:
1. Verifying your identity;
2. Pick up, deliver and track product and service trading;
3. Provide products and services you request (such as logistics, supply chain management, authorized for licenses application, and financial services);
4. Provide customer support and respond to and communicate with you about your requests, questions and comments;
5. Establish and manage your account;
6. Communicate about, and administer your participation in, special events, programmes, surveys, contests, prize draws and other offers or promotions;
7. Send information to your contacts if you ask us to do so;
8. To ensure the Company are being operated properly and safely and for security reasons. Video recordings will be disclosed to law enforcement suppliers, agencies, the legal owner or management company of the premises when necessary；
9. Process claims we receive in connection with our services;
10. Matching (as defined in the Ordinance) your personal data with other data collected for other purposes and from other sources including third parties in relation to the provision of goods, services to you;
11. Marketing and advertising of any goods, services to you by the Company, related companies, agents, contractors and third party suppliers upon your consent in accordance with the prevailing requirements in the Ordinance;
12. Business planning and improving goods, services supply to you, by the Company, related companies, agents, contractors and third party suppliers, which may be performed by various means including without limitation research, analyses and/or surveys;
13. Analyzing, verifying, enforcing contractual rights, and/or checking of your credit, payment and/or status in relation to supply of goods and services to you;
14. Enabling the daily operation of your account and/or the collection of amounts outstanding in your account with the Company including the use of debt collection agents;
15. Maintaining and developing our business systems and infrastructure, including testing and upgrading of these systems;
16. Keeping you informed about goods and services supplied to you and other goods and services made available by the Company;
17. Prevention, detection or investigation of crime;
18. Disclosure as permitted or required by law; and/or
19. Any other purposes as may be agreed to between you and the Company.

AGREET

By submission of your personal information for the purposes for which it is collected, you indicate that you have read and understood this privacy policy and you are consenting to our collection and use of your personal information in association with all purposes described in this policy. However, we may not use your personal information, including your name and contact details, in direct marketing unless we have received your express consent, such as filling in “Submit”, “Contact Us” or “Subscription” form or enquiry.

Use of Data in Direct Marketing

After you fill in “Submit”, “Contact Us” or “Subscription” form or enquiry, we will use your Personal Data for direct marketing purposes. We shall use your Last Name, First Name and Email Address for marketing of the following services and products:
1. Products and services of Hai Shi Machinery & Equipment Co., Ltd;
2. Commercial merchandises of Hai Shi Machinery & Equipment Co., Ltd;
3. News, rewards, promotions and events related to or offered by Hai Shi Machinery & Equipment Co., Ltd and its subsidiaries, associates and/or affiliates.

RETENTION OF PERSONAL DATA

Personal data will only be retained for as long as is necessary to fulfil the original or directly related purposes for which it was collected, unless the personal data is also retained to satisfy any applicable statutory or contractual obligations.

DISCLOSURE OF PERSONAL DATA

All personal data held by the Company will be kept confidential but the Company may, where such disclosure is necessary to satisfy the purpose, or a directly related purpose, for which the data was collected provide such information to the following parties:
1. Any subsidiaries, holding companies, associated companies, or affiliates of, or companies controlled by, or under common control with the Company;
2. Any person or company who is acting for or on behalf of the Company, or jointly with the Company, in respect of the purpose or a directly related purpose for which the data was provided;
3. The Company’s dealers, agents, contractors, suppliers; its professional advisers, including its accountants, auditors and lawyers;
4. Government and regulatory authorities and law enforcement agencies and other organisations, as required or authorised by law;
5. Any proposed or actual participant, assignee or transferee of all or any part of the Company’s operation or business;
Personal data may also be disclosed to any person or persons pursuant to any statutory or contractual obligations or as required by a court of law, provided such person or persons are able to prove the required right/authority to access such information. In addition, personal data may be disclosed under any of the circumstances described in Part VIII of the Ordinance in which the concerned personal data are exempt from the provisions of Data Protection Principle 3 of the Ordinance.

TRANSFER OF PERSONAL DATA OUTSIDE HONG KONG

At times it may be necessary for the Company to transfer certain personal data to places outside the Hong Kong SAR in order to carry out the purposes, or directly related purposes, for which the personal data were collected. Where such a transfer is performed, it will be done in compliance with the prevailing requirements of the Ordinance.

SECURITY OF PERSONAL DATA
All physical computer data is safeguarded by storing in locked cabinets. Computer data is stored within computer systems which are protected within server room with access control system. Storage media will also be placed in cabinets or server rooms.

LINKS TO THIRD PARTY WEBSITES

Our websites may contain links to other sites and pages which are operated by third parties. We have no control over the content of the linked websites or the way in which the operators of those websites deal with your personal data. You should review the privacy policy for those third-party websites to understand the ways in which your personal data may be used by those third parties.

DIRECT MARKETING

Upon customer’s consent, the Company may use his or her personal data (including name, contact information, and information about the products and services that he or she has purchased or subscribed to) to deliver to customer, through various communication channels by using email address, correspondence address, mobile phone number, telephone number, service number and service account number, etc., various promotion materials including the Company’s latest offers, gifts, discounts, benefits, information relating to the Company’s products and services, computer peripheral, accessories and mobile applications, personal assistance services and information services. Customer may also be provided with the latest offers on various kinds of products or services. For the avoidance of doubt, this consent can be withdrawn at any time as per this Privacy Policy without reference to the duration of the services, and will survive the termination or expiration of customer’s service contracts.
Customer can at any time send request to our Information Technology Department together with your contact details to stop receiving the promotion materials aforesaid or to start receiving the same (if customers have unsubscribed from receiving such materials before).
Any such request should clearly state the details of the personal data in respect of which the request is being made.

YOUR RIGHT TO ACCESS, CORRECT AND DELETE DATA

We take all reasonable precautions to ensure that the Data we collect, use and disclose is accurate, complete and up-to-date. However, the accuracy of that Data depends to a large extent on the Data you provide. You have a right to request access to, and correction of, your Data and we recommend that you:
1. Let us know if there are any errors in your Data; and
2. Keep us up-to-date with changes to your Data.
If you wish to access or amend any of your Data we hold, or request that we delete any of your information that is no longer necessary for the provision of our Services, you may contact us in writing at（marketing@hsm-is.com）or mail us to B2-3, 28/F, TML Tower, No. 3, Hoi Shing Road, Tsuen Wan, New Territories. We may apply an administrative charge for providing you with access to your Data in response to such request. You may decline to share Data with us and/or withdraw any consents which you may have provided, in which case, we may not be able to provide you with some of our Services.

To raise an issue regarding our handling of your Data, please contact us in order that we can attempt to resolve your issue.
This Privacy Statement may be amended from time to time and all handling of Data will be governed by the most recent version of this Privacy Statement, available on our website at (www.hkt.com/legal/privacy.html). If there is any inconsistency between the English and Chinese versions of the Privacy Statement, the English version will prevail.
